Search Merced County Traffic Court Records

Merced County traffic court records cover citations, infractions, misdemeanors, and traffic-related warrants handled by the Superior Court of California, County of Merced. A Merced County traffic court records search runs through the court's Traffic Building on West 20th Street, the Los Banos Falasco Justice Center, the Criminal Division for DUI or DWI matters, and the court's Online Payments portal. Traffic case information sits outside the public online portal, so most searches happen at the counter or through MSC-RR-001.

Which Courts Handle Merced County Traffic Cases

California abolished its separate justice and municipal courts after the 1998 trial court unification. Every traffic case in Merced County sits inside the Superior Court rather than a stand-alone traffic court. Day-to-day work still splits across buildings.

What Merced County Traffic Records Show

A traffic record returned at the counter or in a copy request shows the basic facts of the stop, the charge, the court date, and the disposition. Paying or Contesting a Merced County Traffic Ticket

The ticket itself is the playbook. The bottom of the citation lists the appearance or notice-by date. Missing that date can trigger a civil assessment, a license hold, or a failure-to-appear warrant.

  1. Read the citation and note the appearance or notice-by date.
  2. Pick a path: pay the bail, request traffic school if eligible, plead not guilty at arraignment, or request a court trial.
  3. Pay by mail with a check or money order to Merced Superior Court, by phone, online through the court's Online Payments page, or in person at the Traffic Building or Los Banos counter.
  4. Request traffic school under California Vehicle Code § 41501 if eligible. Eligibility is generally once every 18 months for a one-point moving violation in a non-commercial vehicle. The court adds an administrative fee to the bail amount.
  5. Contest the citation by checking the "Trial by Written Declaration" box under VC § 40902 and submitting written statements and bail by the deadline, or appear at arraignment to plead not guilty.
  6. Use the Self-Help Center for fee-waiver questions at (209) 725-4168 Monday-Friday 8:00 a.m.-12:00 p.m. or email selfhelp@mercedcourt.org.
  7. If a citation has gone to collections or triggered a license hold, contact the court before contacting the DMV. Only the court can recall an FTA or FTP.

Public Access Laws for Merced County Traffic Court Records

Traffic court records are part of the trial court records covered by California Rule of Court 2.400. Public inspection at the courthouse is the baseline, subject to sealing orders and confidentiality statutes. Remote electronic access is governed by Rule 2.503, which is why the Merced public portal does not include traffic case data. Search and copy fees come from Government Code § 70627.

Court Traffic Records vs State Driver Records

The court traffic record and the state driver record are two different files. A court record lives at the Merced County Superior Court and shows the citation, charge, disposition, and payment. A state driver record lives at the California DMV and shows points, license status, and convictions. Many drivers ask for "their record" without specifying which one they need.

CDL and Commercial Driver Records in Merced County

Commercial drivers in Merced County are subject to federal Motor Carrier Safety Administration rules under 49 CFR Part 383. Convictions for moving violations in a commercial vehicle, and many serious convictions in a personal vehicle, are reported to FMCSA and recorded on the driver's CDL record. Traffic school is generally not available to mask a commercial-vehicle violation from the CDL record. Two serious convictions within three years can trigger a 60-day CDL disqualification under California Vehicle Code § 15300. Three within three years can trigger 120 days. CDL holders should consult counsel before paying any moving violation that could be reported to FMCSA.

DUI and DWI Cases in Merced County

DUI and DWI cases are criminal matters in Merced County, not traffic infractions. The Criminal Division at the Ogletree Jr. Courthouse handles first-offense DUI under California Vehicle Code § 23152. DUI causing injury under VC § 23153, and DUI with three or more priors within ten years, may be charged as felonies. Some defendants route through the court's DUI Court calendar within Collaborative Courts. Full DUI record-access guidance lives on the criminal records page.

Traffic School and Deferred Adjudication in Merced County

California uses traffic school under VC § 41501 as the functional equivalent of deferred adjudication for one-point moving violations. A driver who completes a state-licensed traffic school within the time set by the court keeps the conviction confidential for insurer and DMV-point purposes for that one citation. The driver must request traffic school, pay the underlying fine plus the court administrative fee, and finish the course before the deadline. Eligibility is generally limited to non-commercial-vehicle one-point infractions and is restricted to once every 18 months.

Note: Traffic school is not automatic in Merced County; the driver must request it from the court before the deadline on the citation or risk losing the option.

Sealing or Expunging Merced County Traffic Records

Traffic infractions are not generally eligible for Penal Code § 1203.4 dismissal, because that relief turns on a probationary sentence and infractions do not involve probation. Misdemeanor traffic convictions like driving on a suspended license under VC § 14601 can qualify for § 1203.4 relief if the defendant completed probation. Arrest-record sealing under PC § 851.8 or PC § 851.91 may apply to a traffic-related arrest that did not result in a conviction. Juvenile traffic matters follow Welfare and Institutions Code § 827 confidentiality and the juvenile sealing path under WIC § 781.
